Hi All,

Please I need some advice.

I am a Non-EEA Family Member (Spouse) to a French National. We were married over a year ago in the UK, and we were both happy and lived in the UK. At the time, I was working and soon after I lost my job.

My wife got an offer for a job in France and decided to move while I remained here. I started a new business in UK, employed 2 people on a commission basis, and although going through the challenges of the formative years of any business, there are some signs and prospects of growth every though I have not broken even yet. (Just over 6 months).

Now, my wife wants me to move to France but am concerned that I will lose all that I have built during this time. Some top companies (6 of them) have already written to me that they're interestedin doing business with me in the next calendar year so I do not want to lose out on this.

My worries are if I moved to France, I might lose my residence, my company might be shut and my business bacnk account too.

What should I do? As my wife wants me to apply for a Long-Stay visa to france, and although I want us to live together.. I want to be able to travel to the UK to continue building my business without having to apply for Visa. Meanwhile, I don't speak french and no job for me in France and honestly, I do not want to depend on my wife at all while in France, it makes me uncomfortable.

What should I do? Can I move to France but able to travel and conduct my business in the UK with border issues as a non-EEA national married to a EEA member?

Your residence in the UK is derived from your partner so if she is not exercising treaty rights in the UK your right to remaim there will not be valid. She must spend at least six months per year in the UK.

As the things stand, since your wife has moved to france, you have lost your right to remain in UK. As per the law, you should not be here.

In case you stopped by police, or end up in a place where UKBA is doing their routine immigration checks, and if they find out your wife has left UK, then you will be sent packing on the next flight home.
