Can I apply for settlement if I am in Tier 2 ICT Long term s

I came to UK on a Tier-2 ICT long term visa in Jul 2011 and have been working here since.

If I complete 5 years in UK, can I apply for settlement? The rules says that

"a Tier 2 (Intra company transfer) migrant under the Immigration Rules in place before 6 April 2010;"

Does this mean that if you have got your visa after 6 April 2010, you cannot use this rule for applying for settlement?

you will not be eligible for settlement after 5 years on T2 ICT.
