Can I send a fresh application after refusel

Hi every one . me and my friend applied, we both got refusal. my friend has right of appeal because his PSW visa is expired. i have no right of appeal because i have still got visa until April..


Can we both do a fresh apply. i know i can apply but my friend can apply or not.

And what is going to happen if my friend appeal is in process, and my visa is near to expire. can i send a new application on the same docs. or i need to change my team member and business details.

u and ur friend can make a fresh application however ur friend refusal shudnt be more than 28days old at the time of application and no appeal pending at the time of application.

if if ur friend go for appeal then u cud make fresh application at ur own.

There are two scenarios for your friend, in each case you can also make application with your friend:

1) If he has not lodged appeal and wish to apply then he could do so within 28 days after refusal. But he will be considered overstayer during this time.

2) If your friend has already lodged appeal then he cannot put fresh application until his appeal dismissal OR until withdrawal of his appeal. As soon as his appeal process finish; he could apply within 28 days. But he will be considered overstayer during this time.

If you only want to put new application alone; you can do it. But make sure to prove yourself genuine entrepreneur in the assessment.

Sorry i forgot to mention that both me and my team mate were refused visa and the decision from the ftt was negative and the utt did not submit thr appeal even though we submitted a fresh bank statement in the correct format with all the necessary details. Please help

Have you been refused based on insufficient evidence to confirm access of funds to both team members.

Yes our awful lawyer did mot present the bank letter in the correct format with the application, when the immigration office asked for it in post and even at the appeal hearing in th ftt 😔

hi,it will be very helpful for me if anyone suggest me in my present situation,,,I apply for psw april 2012,refused on january 2013 (reason date of award)...ftt hearing july 2013 again refused on august 2013...now appeal in utt ,,,still waiting for the permission,,,in this situation can i make new application in different category...am i consider to be over stayer...please help me ...

@ masuma123, you are still not an overstayer until your upper tribunal case is finalize. You can make plan for a new application and submit it within 28days of the upper tribunal decision.
