pls help for eea 2

Post by kunleswags » Sat Oct 26, 2013 8:25 pm

Hello obie, jambo, sheraz EUsmile and other distinguished board members.my eu wife works for a care agency which basically sends her to different care homes and hospitals subject to availability of work or more like on a zero hours contract.she works minimum of 20 weeks weekly.dis week a strange thing happened which is that they wrote to them that they will be registered as self employed people for purposes of tax and national insurance and told her and other workers to get in touch with an accountant which is contracted to the agency to help facilitate their registration as self employed.my question is that is this normal and can one be a worker and be registered as self employed by the company one works for for tax purposes.secondly, will home office regard my wife as a self employed person or employed as per exercising treaty rights?

The situation you described above then I believe it will be more likely self employment because an individual itself will pay taxes instead of employer. Self employment can be carried out even with individual own name instead of registering company.
This web link can further give you information about self employment:

For knowing the documents for proving self employment read:
