Can we list multiple SOC codes on the application form

Post by adnaan_23 » Mon Oct 28, 2013 2:42 pm

Hi

I've gone through the guidance notes and the application form but couldn't really find a definitive answer to this...for example, if someone wishes to set up a company that provides a range of services spanning across more than one SOC code and there isn't one "core" sector, is it ok to list all the relevant codes on the application?

Of course I do realise that in order to satisfy the "genuine entrepreneur test" you'll most probably need a strong background (work exp, qualifications, certifications etc) in each of the sectors, there's no point pulling these SOCs out of thin air.

Wondering if anyone can shed a bit more light on this.

Cheers

@adnaan_23:
Actually you found a definitive answer but the problem is, you did not find it according to your situation. Dont mess up, just select the most appropriate stuff you are looking for to business in. Each SOC is a whole Domain, not just 2-3 lines of services in the contract. Better to keep things simple rather than "Jack of all trades, Master of none".

Guidance policy point 122:
122. You must provide the Standard Occupational Classification (SOC) mode of the occupation that you are working in, and confirm that this appears on the list of occupations skilled to NQF level 4 or above, as stated in the Codes of Practice. More information on selecting this occupation is given on our website at
http://www.ukba.homeoffice.gov.uk/busin ... fpractice/
To find the relevant code of practice for your occupation, you must first identify the SOC code that most closely matches your work (other than the work that you do to administer your business). You must also check that this SOC code is listed in the Codes of Practice as being skilled to at least NQF level 4. The SOC codes are published by the Office for National Statistics. Please do not ask us to match a job title or a job description to a SOC code for you, you must make this decision based on your own duties and responsibilities.

So where exactly does it say that your business has to conform and fit within only one SOC?

With regards to the SOC being a whole domain...they are primarily designed for work permit applications and not as a means of classification of business activity. In fact, that's part of the problem and the main reason quite a few applications are getting refusals, only to be overturned in appeal.

Businesses can be very dynamic and multi faceted. As I said, it's not a question of putting together a few SOCs just for the sake of it...

1) At least wordings of point 122 state that there should be one core business stuff you are looking for. It does not exactly state there could be multiple.

2) Yes these are primarily designed for work permit applications. But also referred for Tier1 Enterp Visa in immigration rules. When you select some occupation for you; you automatically select your business activities under that occupation OR when you define your business activities; you have to select related occupation for you. In either situation, applicant is connecting occupation (SOC) to business activity as well. This is what point 122 states as well.

3) Business can be very dynamic and multi-faceted. It depends on Case Worker if he or she is familiar with this philosophy. I personally came out of this dilemma because judge listened me.

If you want to start an XYZ Enterprise Ltd... You will have to satisfy the rules. Simple

Hmm, ya I totally get your point about the case workers...in grey areas like these it depends so much on how they interpret it.

and now I put my suggestion forward,

pasting more than one SOCs on application form is not harmful so can not cause a refusal on SOC respectively. believing the fact that you involve yourself doing that you write on application using SOCs you wanted to tell at the time application is the justification to it.
like you mentioned they designed SOC for Tier 2 potential applicants and you can not help it because your roles and responsibilities fit in more than one SOCs and SOCs you choose if more than one shall all be more closely presenting your roles that you perform for your company.

you should also know before me that it is the nature of the business where services provided to clients are classed as your real SOC instead of your services to your company as rest is administrating a business, however I am the prime example of doing so where I placed 3 different SOCs in accordance with my knowledge this applicant(a friend of mine) is truly involved and there has not been any problem with his application in relation to SOC provision.

thanks..

That's encouraging to hear.

So what "job title" did your friend put in on the application? Did he put multiple job titles as well??
