Question - 6 years vs. 12 months ILR

Hi all,

I am an EEA national from Latvia who lived in the UK for 6 years.

I came here in September 2007 and lived in the UK for more than 5 years (5th year ended on 25th of September 2012 and the 6th year ended one month ago).

So technically I lived in the UK for 6 years and 1 month.

However, I applied for the permanent resident status approx. 10 months ago and received the permanent residence passport sticker on the 11th of February 2013.

And now I am a bit confused by requirements listed in Section 6 of the Booklet AN:

"...you should normally have
held permanent resident status for 12 months before applying for naturalisation. This
means that you may need to wait until you have been in the United Kingdom for 6 years
before you can apply."


As you can see, I lived in the UK for more than 6 years (and have all the required proof of that), but I haven't had my permanent resident status for 12 months (right now it would be 8 months only).

So I've got two questions:

1) Can I still submit my completed Form AN or is it likely to be rejected because of the insufficient amount of months I held my permanent resident's status?

2) The Booklet AN (again, section 6) states that an EEA national acquires permanent residence status automatically after living in the UK for 5 years.
So which date should I put in Form AN, Section 1, question 1.3. ("Please say when you were given indefinite leave to remain in the UK"): should it be 11th of February 2013 (date when I received my passport sticker and confirmation of the ILR) or September 2012 (when my 5 years of living in the UK ended)?

Any advice would be greatly appreciated!

As long as the date used in 1.3 is more than 1 year ago, that's fine.

My apologies for asking one of the common questions; I've tried searching for multiple different keywords and phrases, but for some reason didn't find this FAQ thread...

The logic is the PR card only has issue date. It doesn't state when PR was actually acquired. If you want to use an earlier date than the one on the card, you will need to provide proof of that date.
