Tier4 visa question - switching and dependent related

Hi


I want to study graduate course , can i switch from ICT Tier2 long term staff dependent to tier4 within UK ?

If i am staying as student for next 4 years, can my husband and kid stay with me - as per UKBA site - it states that
"If your dependants are already in the UK with permission, they will be allowed to extend their stay provided they apply at the same time as you apply to undertake a course of study lasting more than 6 months.
"

Does that mean my husband and kid stay with me till i finish the course ?
Can my husband work ?

CAN SOMEONE CLARIFY ME THAT STATEMENT FROM UKBA SITE .

The rule you have quoted only applies if your dependants are in the uk as tier 4 dependants. You will only be able to bring dependants if you are:
sponsored by a higher education institution on a course at NQF level 7 or above which lasts 12 months or more; or
a new government-sponsored student following a course which lasts longer than 6 months.
You cannot switch from ICT dependent to tier 4 migrant from within the UK.

Thanks a lot.

I am not planning to switch within UK. I am planning to go to india now , then will apply for student visa.

My husband is working here currently - if i return as a student to uk can my husband switch to tier4 dependent within UK and can he stay till my visa expiry ? (Even if i study NQF level 6)

No your husband cannot apply as your dependent if you are studying an nqf level 6 course unless you are government sponsored.

Okie if i study some course NQF level 7, can he switch within UK ?or does he need to go back to india ?

From October 2013. People can switch into certain dep categories in the UK so far as the leave they are currently on is not listed I.e. Visitors etc. see the October 2013 Statement of Changes.

Only if the course is at least 12 months long and at an HEI
