ROA for infant from within India. Please advise

Post by BI91374 » Tue Oct 29, 2013 8:32 pm

Dear Friends,

I am a British Citizen with Indian Origin (OCI card holder) and I have an enquiry about my to-be born baby and how do I get CERTIFICATE OF ENTITLEMENT for RIGHT OF ABODE in UK for my to-be born child.

I am trying to explain my situation below:
--I am a British Citizen with OCI (Overseas Citizen of India) card. I received my British Citizenship last year through Naturalization.
--My wife is an Indian National with "Indefinite Leave to Remain in the UK" visa.
--I work in the UK and currently living in the UK with my family but planning to travel to India for baby's birth due in April 2014.
--We are looking at ways to get back to the UK as soon as possible with new born baby.
--I am considering getting an Indian Passport for the baby through his/her mother and then apply from Certificate of Entitlement for Right of Abode in the UK through me.
--Since I am a British Citizen, my child will be a British Citizen & hence will be eligible for Certificate of Entitlement (CoE) for Right of Abode (ROA).

I have a couple of queries I hope you can help me with:

--Can I apply for CoE for Right of Abode in the UK for my to-be born baby from within India ?
--Where do I apply for CoE for ROA in India? Is it at British High Commission in New Delhi?
--What is the process of applying for COE for ROA from within India?
--What is the maximum and minimum processing time for COE for ROA?
--Is their a premium service available in India for COE for ROA?
--Are there any quicker ways to come back to the UK asap after baby's birth in India? I understand I can directly apply for my baby's British Passport from India, but it takes around 16 weeks. I think CoE for ROA route is a lot quicker.

Please advise.

Thanks and Regards:

Apply from India, if baby is in India.

Dear Vinny,
Thanks for your response. I went through all the links you shared in your response, but couldn't figure out:
1) Where in India to apply for CoE for RoA?
2) What is the approximate processing time?

also, do you have any recommendation for a solicitor/lawyer to take advice from?

Please help.

Kind Regards:

Apply here, at same place where one applies for a UK visa. It should be straight forward as child is a British citizen by descent.
