Post by alijay7 » Wed Oct 30, 2013 9:56 am

I have been in the UK for 8 years. Presently, Im on a PSW expiring in 3 weeks, I couldnt find a COS so i went to register to finish my CIMA in order to switch to tier 4 but i found out that I have used the 5 years stay as a student in the UK. Im a part qualified accountant and I dont know what to do now.Could you please help me?

you can apply for leave within 28 days of the expiry of your visa, i.e. within 7 weeks from now, if you find a Tier 2 General sponsor who is prepared to assign a CoS to you. As you would be switching from T1 PSW the resident labour market test is not required and the minimum salary needed is that for new entrants.

one proviso though. If you apply within the 28 days window and the application is refused for whatever reason you will not get the right to appeal.

Once again it's helpful to know. My worry is the CAS assignment might take a long time making me fall in that 28 days category but thanks for the reply.

kind regards,
