Tier -1 (general) Extension age Query

Post by shane123 » Wed Oct 30, 2013 3:23 pm

Hi,

My First application for Tier -1 (general) was on 05-Nov-2008 which was refused on the grounds of not maintained sufficient maintenance fund.

On 31-july-2010 I requested a review of the refused (above dated) application for further leave to remain under Tier-1 general following the judgement in SSHD Vs Pankina(2010) EWCA Civ 719 and the policy document published on the UK Border Agency website on 23 July 2010. For this appeal I been approved the visa for the original application and given me the leave to remain starting on 04 Feb 2011 until 04 Feb 2014.

My question is when I apply for the TIER-1 General Extension (PBS), What will be my score for the age. since in the Tier 1 (General) Policy Guidance version 10/2013 Page 9 of 35, the Age column states that at date of application for first grant. My date of birth is 28-11-1980, if so do I score 20 points for the age which when I take my first application was on 05-Nov-2008.

Please advice me on this, since I'm looking to go for the Tier-1 Extension next month.

your help will be much appreciated.

regards,
SH

Ideally you should be claiming the points dated your first application, i.e, 05-Nov-2008.

What were the points awarded on your first grant ie., from 04th Feb 2011 to 04 Feb 2014? It should be the same as this.

Many thanks O_Relly..

I had scored 20 points for the age in my first application in year 2008.

Then it's clear, 20 points for age it is.
Cheers.
