Making Fresh Application

Hi All, i have applied for the Tier 1 Visa from post study work on last week as an entrepreneur team from post study work. i have applied one day before my current leave expires. now my question is if my visa get rejected do i have option to make an fresh application for student visa or tier 2 work permit? i mean while my appeal is ongoing can i withdraw my appeal and apply for a new visa under the immigration act 3c-3d. any suggestion would be appreciated guys. thanks
