ECHR immigration cases

ECHR immigration cases

My FLR O was refused in March with no appeal and no removal direction. Solicitor has sent reconsideration letter to HO with no response 6 months on.

Have now made claim on breach article 8 direct to ECHR court in Strausburg.

Has anyone had any experience of ECHR cases.

I'm overstayer nearly 12 years with uk born fiancé of 2.5 years.

The ECHR can only go ahead with your application until you exhaust all appeals in UK. Base on my own experience in January 2005.
Laws and Rules can change anytime obviously things are no longer the same.

Then perhaps consider marrying/registering a civil partnership and applying for spouse leave outside the UK or via the EEA route if you don't meet the requirements.

Tried to apply but told cant cause immigration decision was given. Has right appeal on human rights once issued removal directions.
