Hi there,

I am on a Tier 2 (General) visa at the moment, sponsored by my employer which I was granted in April. However, the company is not doing too well and I'm looking for new opportunities. I have met with a few companies and they're ready to sponsor me, but they want the answers to a few questions, namely:

1) Do they ask for a restricted or unrestricted CoS?
2) Do they need to satisfy the requirements of the RLMT? If so, where are you supposed to advertise for 28 calendar days besides the JobCentre website? I cannot find this list any more.
3) I have applied to companies that have offices 3-7 offices abroad, does advertising on their website count?
4) Will my salary be new entrant or experienced? The SoC code will change.
5) Am I allowed to start work for 20 hours a week for my new sponsor until the RLMT is carried out, assuming that no settled worker is found?

if "they", i.e. your prospective employers, are asking these questions it is doubtful that they are licensed T2 sponsors. Their cluelessness indicates otherwise. Your experience with your current sponsor in April should make you wary. The answers to "their" questions are in the T2 sponsor guidance

Re. your Q5 - you are allowed to undertake supplementary employment for max 20 hours per week with any employer, they don't have to be T2 sponsors and RLMT is not necessary, however, the job must be in the same sector and at the same professional level as the one for which you have your current CoS (unless it is a shortage occupation). See the T2 policy guidance, paras 209-210.

Thanks Manci - no they aren't a licensed sponsor but are willing to get the licence to sponsor me, which is why they had so many questions :)
Also have another with a company that already has a licence, they seem to be okay to do the RLMT, no questions asked and sponsor the visa.

Hi Manci,

Just another very weird question.

I have not been paid for October and November. I know legally that this is okay as it is not over a 30% reduction and this has been adopted to avoid redundancies.
I have volunteered to go on unpaid leave for December and January hoping it will buy me more time. I know this is legal too as I am allowed to take one month of unpaid leave every calendar year.
My question is - what am I supposed to do about payslips? I have found a new job and someone to sponsor me but I'm a bit worried about this as I've already had my Tier 2 rejected once this year!
