NEED PROFESSIONAL ADVICE PLEASE ASAP

M psw visa was expiring on 18th august 2013. I applied for enterpreneur visa in may 2013, got refusal on 7th august 2013. I made another fresh application on 15th august 2013 (before my visa expiry). My application was succssful 2nd time.
I am in Uk since last 9 years, never had visa refusal before.

can i apply for 10 year residency in august 2014 without any problem? just worry because of recent refusal but i made new application before visa expiry anyway?

2nd question is, can i continue work for my company on their payroll, because they wont keep me as self employed? next year i will be applying indefinite on behalf of 10 year law ful residency?

please answer my above 2 questions, I am really confused.

You should be continuously legally resident for 10 years to claim long residency based indefinite leave. As son as you qualify; you can apply.

You cannot work on payroll (PAYE) basis. Doing so will be your own decision and consequences might loose the effectiveness of previous 9 years due to breaching the immigration law. Your HMRC records could expose you easily.

You will easily get indefinite leave to remain, no doubt. But when you say that you are working for other company so for your kind information. HO & HMRC are well connected with each other now specially in permanent residency cases. You can be in big trouble because of this. Why do not you work as a sub contractor to them through your company. At least try. BEST OF LUCK

RizKCB, Could you clarify it further, as you said "we cannot work on payroll (PAYE) basis" but my understanding is that we can be on payroll (PAYE) basis on our own company? please correct if i am wrong thanks

I meant here to get pay from other business/employer. You can take your pay/remuneration from your own business/company but it would not be counted as investment.

Have court hearing for tier one entrepreneur visa. please help is home office lawyer or judge ask questions if yes what are the possible questions.
