Which set of rules???

My friend applied for a tier General 1 visa on the 16th Oct 2008, application refused 24th March 2010. Won on appeal and visa issued on 9 Nov 2010.
I would like to know what rule applies for extension.

The old rules will apply, the same as how he was granted points in his first grant. His date of first successful application is 16 oct 2008.
