Please help with financial requirement

Post by Ninush » Tue Nov 05, 2013 11:53 am

Hello everyone,
I'm about to apply for a fiance visa. My sponsor and I want to apply under categories B and C. My sponsor had several non-salaried jobs in the last 12 month period. Since October he is in a salaried employment and his monthly payment is 1690 gross. Before that the actual gross ammount he has earned is:
November 2012 - 1176,5
December 2012 - 1181,38
January 2013 - 1210,63
February 2013 - 1166,75
March - 1157
April - 1108,25
May - 1181,38
June - 1442,25
July - 1648
August - 2852
September -1580
As I understand current rules for category B we should meet the requirement in 2 parts:
1) The current employment should be at least 18 600 gross per annum So 1690x12=20 280 We meet this requrement
2) The person must in addition have received in the 12 months prior to the date of application the level of income required to meet the financial requirement So we count it by adding all the actual income he has received: 1176,5+1181,38+1210,63+1166,75+1157+1108,25+1181,38+1442,25+1648+2852+1580+1690=17 394,14 That means that we dont meet the second requirement. BUT my sponsor is a student and he is in receipt of a maintenance grant of 3080 tax free for a studing year 2013/2014.

My question is how should we combine this two categories?

I appreciate any help!!

Nina

What do you mean? I am not in UK, therefore my income wouldn't count. Why are you asking?

6.4.3. A tax-free grant or stipend can be combined with income on which tax has been paid and
with current cash savings. The decision-maker should add together:

(i) The annual tax-free amount of the grant or stipend;
(ii) The annual post-tax (net) amount of any employment or other income (if the requirements of Appendix FM-SE in respect of that income are met); and
(iii) The relevant amount of current cash savings (if the requirements of Appendix FM-SE in respect of those cash savings are met),
