An application question

Post by joanna2014 » Thu Nov 07, 2013 8:43 pm

Hi this query is regards. For my close friend and my question is on his behalf please have a look

Hi ,I'm jack
I would appreciate if a guru would answer my query,
My wife is from Poland , we are married over 6 years I got my permanent resident 2 weeks ago , can I apply for nationality now as the EEA law says that one can apply for nationality after 6 years , I believe I attained my permanent residency after being married for 5 years , the reason I want to rush is that I was issued FPN 6 points and fine for driving no insurance , I asked for the court hearing , the court send me the summon and plied not guilty and asked then to send me a date for court hearing , my question is if I apply for nationality would it appear in their system that I have pending court hearing and also can I apply for nationality now ( married more than 6 years) when I just got my permanent residency ,
I would really appreciate any advise ,

You should not apply until the court case is decided. If you do, you must inform them of a pending prosecution and the case will just be put on hold until a verdict. If you don't tell them you could face criminal prosecution (section 46 of the British Nationality Act 1981) and a 10 year ban. If you apply and are found guilty, you'll get rejected and lose your fee.
