Refusal for resident card

Refusal for resident card

I have just got refusal for resident card . My wife is EEA Member and i have applied on her basis . when i applied for resident card my spouse was jobseeker but now she is working since last two months . I got refusal mentioning that -
your EEA national sponsor is not registered with the Department of work and pensions as a jobseeker .
- your EEA national sponsor has been a jobseeker for a period in excess of six months .
- your EEA national soponsor has not evidenced that they are actively seeking work and have a genuine chance of engagement .

letter is ask me to make arrangement to leave . i am also having a job and working here and my visa is also finished .

Please advice weather i should go for appeal with all the evidence that now she is working or need to leave country.

We have child going to school in uk and she is also EEA National .

Please advice ASAP how should i move further as i got letter dated 30th october and if i appeal the i need to do this within 10 working days (although i got letter today 7th november) i have time till 13th november

COOL DOWN !!

quickest and easiest way is to send a new application with payslip, employment letter again

don't worry if you are family member of EU national ( you are married i guess )

they won't kick you out if your EEA family member is working in the UK

You could ask for Reconsideration and appeal at the same time, just in case the come up with something else.

The fact that she secured a job is evidence that after the six months, she had a realistic prospect of securing work.
