Visa Appeal refused - What are my options?

Post by mangomm » Fri Nov 08, 2013 1:22 pm

Hello all,

My visa application was refused based on an error in my Certificate of Sponsorship -- there was an issue with my employer listing my salary for its 8 month contract, rather than what it would be if it were a per annum salary.

We requested a paper appeal, and I have just received a letter from the Home Office stating they will not reconsider my application. To be exact, the letter reads:

"We cannot be expected to interpret the information stated on the CoS or request clarification when no obvious mistake has been made. I am therefore satisfied that the application was correctly considered and refused ... it is not appropriate to reconsider your application.'

What are my options? Is it time to vacate the country within 28 days?

I presume you have actually appealed to the tribunal and not just asked the home office to reconsider, in which case you need to wait for the determination of the tribunal. It sounds to me that what you have received is the home office's response/argument against your appeal which the tribunal will consider when your appeal is considered.
