Hi,

My wife came to UK on Work Permit Dependent VISA in April, 2008. She had applied for HSMP in India before coming to UK(it was 2 step process at that time - HSMP Letter + Entry Clearance). She moved on to Tier-1 from December'2008 and did entry clearance in January'2009 from India.

So technically her Tier-1 VISA was given on 19th December'2008 but she did entry clearance to UK on 11th January'2009.

On what date she will become eligible for ILR(5 year completion)? 19th December'2013 or 11th January'2014?

If it is 19th December'2013 based on 90 day rule, can she book ILR appointment 28 days before 19th December?

Since she entered the UK within the first 90 days, she will be eligible 19 Dec 2013, and yes, she is eligible to apply 28 days prior to 19th Dec.
