new english requiremnt from 28th oct for HSMP JR covered

Dear Members,

I would like to get clarification on applying for ILR, based on the new rule effective 28th october 2013 regarding knowledge of language requirement.

I am covered under HSMP forum ltd judicial review settlement policy as i originally made application for HSMP between 3 april 2006 and 7 nov 2006.

I got visa in Jan 2009 and got extension in 2012 according to JR policy.Although both times visa stamped tier 1 general as HSMP category closed.

As judicial review policy document states that we are exempt from KOL and life in uk test at the time of settlement.

I checked new set(o) form and it shows 2 categoreis under section B

One is Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial Review Policy Document and other is Highly skilled migrant under the terms of HSMP ILR judicial review policy document. Could you please explain diffrence between two and whether both category is exempt from KOL and LIUK test. As section 4 states that later category is exempt from the new KOL and LIUK test but nothing mention about tier 1 covered under JR category.

Could you please clerify that me and my dependent is exempt from this new requirement of knowledge of language or not?
