Urgent: dependant online form question

Post by Tier2Imigra » Sun Nov 10, 2013 10:37 pm

Hello everyone,

I am already in UK for over 2 years on tier2.

1. Now applying for wife visa in online form, one question in section 4 asks?

"will your spouse / partner be travelling with you?"

I will be travelling with my wife when she comes to UK but I don't need visa etc for this, so should I say yes or no?

2. also in section 6, when is job expected to finish? I have permanent job, so what should I enter here as only date can be entered here!

3. section 6: employment and finances; is this about main applicant (me)?

Please guide me urgently as there is outage soon for online application and I want to apply before that!

Thanks again

1. Say no. That way her entry will not be linked to your presence next to her. That is not to say you can't travel with her if you so choose.
2. Put the date of expiry of your current visa. That's not to say that it will actually end on that date, which could be much sooner or much later.
3. All the questions on the form are addressed to the applicant, even when referring to the circumstances of the applicant's sponsor, so you need to look at the context. However, in spite of this, one might assume that any current job or income of the applicant would not be relevant after relocation to the UK.

Hi Luca,

its a totally unrelated question but can you please confirm if tenancy agreement is must and should while applying Dependant visa from India?

UKBA site does not anywhere mention about tenancy agreement to be sent while applying for dependant visa as per docs requirement.

Can you please confirm.

Thanks
Sam

Hi Luca,

Thanks very much for the quick reply,
So, the tenancy agreement is a must only if the dependant visa involves a child and not for Wife alone.

Sam

The immigration rules for a child PBS dependant state that adequate accommodation must be provided. There is no similar requirement in the rules for an adult PBS dependant.

(l) All arrangements for the child's care and accommodation in the UK must comply with relevant UK legislation and regulations.

The paper application form is VAF10 but that is only for use in locations where on-line submissions are not mandatory. You can look at the form here but check as to whether this can be submitted in your partner's location.

So, given that fact, you need to look at the context of the question: A question that asks What is your income? would be asking the applicant to declare her income; a question that asks What is the income of your sponsor? would be asking the applicant about the income of her sponsor (in this case, you). I imagine it's the former rather than the latter but I don't have the on-line form in front of me. So if I am right and she has no income you can state zero!
