Change of Sponsor b/w 5 year period

Post by RITESHKU » Mon Nov 11, 2013 4:37 pm

Hi Team,

Wasn't sure if there was an existing thread to answer my queries but could not find one and so creating a new thread.

I have been in UK from Feb 2009 on Tier 2 ICT until Nov 12 2011. I had a change of employer for which I had to travel back to India to get my new Tier 2 General visa. This new visa has been valid from Dec 16 2011 (until Dec 2015). I traveled back to UK on 15th Jan 2012.

My question is: I have a approx 34 days gap b/w the day I left UK and the day I got my new visa. But 63 days gap between leaving and entering UK to join the new employer. I had applied for it though on 15 Nov 2011.

I found below information on the page 22 of the document at: http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

"Where an applicant’s continuous residence period includes time spent as a Tier 2 migrant or a work permit holder, annual leave includes a short holiday taken on conclusion of employment, where the applicant applied to work for a new employer within 60 days of the conclusion of the previous employment."

May you kindly let me know if my stay of 63 days is of non relevance when I apply for ILR in Jan 2014?

Kind regards
Ritesh
