Hi guys,
just too stressed on my current situation...actually my wife is 3 mnths pregnent and our family has decided tht she gives birth in poland..so we r planning on leaving to poland next month and not expecting to be back untill end of next year probably...im holding eea2 which expires 2018 and is 10months old now...
my questions r 1)will i b allowed again in uk if we both wer to travel in uk together after a long period of time
2)if i was to travel to india within her stay in poland can i come back direct to poland from india?
3)what precautions should i take while all this period of long stay out of uk?

If you stayed out of the UK for longer than 6 months, that may invalidate your residence card, but you may be admitted again on code1A at the UK border, You should be able to return to Poland using your residence card provided that your wife will be in Poland on your return.

Acceptable absences

Continuity of residence

3. (1) This regulation applies for the purpose of calculating periods of continuous residence in the United Kingdom under regulation 5(1) and regulation 15.

(2) Continuity of residence is not affected by —

(a)periods of absence from the United Kingdom which do not exceed six months in total in any year;

(b)periods of absence from the United Kingdom on military service; or

(c)any one absence from the United Kingdom not exceeding twelve months for an important reason such as pregnancy and childbirth, serious illness, study or vocational training or an overseas posting.

(3) But continuity of residence is broken if a person is removed from the United Kingdom under regulation 19(3).
