tier2ict to settlement

Post by sekhar123456789 » Tue Nov 12, 2013 8:03 pm

Hi
This forum is really useful. Thanks for all the information providing.

I have a query on the ICT to settlement. Please find my work history in UK

1. first time visa ( workpermit) - APR2007 -MAR2008
2. second time visa (workpermit) - SEP2008-DEC2009
3. tier2 ict short term visa - JAN2013-DEC2013
4. now I am in TIER2 ICT long term visa - NOV2013 - DEC 2016

I didt quite understood on the rule before april6th 2010. Am I eligible in applying for settlement here or not. The reason for me asking is I entered first time in 2007 ( so which is prior to april 2010)

Could you please confirm me on this. Thanks in advance for the help.

if I am eligible do I need to switch to tier2 genereal after tier2 ict long term . Please clarify that as well.

Expecting a response please

What happened between DEC2009 and JAN2013?

If you were not in the UK legally during that period, then you had broken your continuous residence for ILR. Therefore, unfortunately, you no longer qualify for ILR under Tier 2 (ICT).

Tier-2 ICT (any sub-category) applicants with entry clearance into the UK after april 2010 are NOT eligible for ILR. Applicants with entry clearance before april 2010 are eligible for ILR AND also it requires continuous stay of 5 years (with allowed absence of 180 days in the same visa category).

If your present visa is Long Term with new entry clearance into the UK after April 2011, then you could extend it in-country for a max. period of 5 years ONLY, but NOT eligible for ILR. Also you're NOT allowed to switch into Tier-2 General category, in-country (which would allow you to get ILR after continuous stay of 5 years in that T2G category). If you plan to switch into Tier-2 General from your home country, then a 12 months cooling-off period applies.

For those with entry clearances in between april 2010 & 2011, they're allowed to switch into Tier-2 General in-country and then after 5 years of continuous stay in that category will become eligible for ILR.

Hope, this helps you.
