Hello everyone,

After many unsuccessful attempts to find a new employer who can sponsor me over the last year and being discriminated and bullied at work I now want to send formal letter to my local MP. I want them to review the legislation and make it easier to move jobs under Tier2 if someone been discriminated or bullied.

It is inhuman to make someone so dependant on their employer and give managers such a big power for bullying you. It is very hard to prove so legal way is not an option. Often the best thing you can do is just leave... but no with this sponsorship requirement no one is going to employ you.

Initially by introducing Tier2 government wanted to improve safety by keeping control over foreign employees but my life is becoming a misery in these terms...

I would appreciate if you will let me know your opinions and if there are other people who are in the same situation.

If you are being bullied and discriminated against in the workplace, you have access to legal recourse, but this is not an immigration issue and not relevant to this forum. If you wish to leave your current position and find another sponsor, you have to follow the procedural guidance for T2 migrants, and this can be found on the UKBA site. Good luck!

Yes I know that bulling is not immigration issue, but someone who had been tided up to the employer like us under Tier2 they have so much less opportunity to change their employer. It is relevant to the law which makes it difficult to find a new employer and stand up for our rights.

Dear Lucapooka, You have to accept that legal procedure against your employer is complicated and lengthy process, so many people when being bullied or discriminated see as a best option to move to a different employer. We as a skilled employees have much less opportunity to defend ourselves.

My employer knows I cant go to a layer. I have sent about 100 applications around (I am qualified experienced and multilingual). I had interviews, but once the recruiter finds out I need a sponsorship they never get back to me again.

I am frustrated, bullied, discriminated and currently seeing a psychologist

Is it really only me who thinks the way I do?? Don't you think sponsorship rules should be simplified?

How come? If the situation is as bad as you describe you need a good employment lawyer and could get massive compensation. To follow this course you would need to collect good evidence.

However, going to an employment tribunal will not alter your immigration position.

I spoke to a layer she said that the most difficult thing in these type of cases is collecting evidences.. It is so invisible.. They smile to you and pretend that they care.. But in reality you are the least they care about.

Anyway I am glad that this is not a mass issue with Tier2..

Hate to break it to you, but the it's quite obvious Tier 2 immigration rules are there not just to control skilled immigrants, but to discourage employers from hiring migrants from outside the EU as well.

Everything is against you, from the legal requirements companies have to comply with, and the costs they incur in order to get a license, to the time it forces companies to wait till they are legally able to sponsor you (after RLMT, COS allocation - if you miss allocation by one day you have to day another 30 days -, application approval, etc).
As a company owner, why would you wait months, set up a framework among ppl in your office to comply with sponsor regulations, and to top it all, pay money to fill in a gap, when you can pick someone from the UK or EU, and have him start working next week, just as easily?
Even if you are the first choice, I can see most companies won't even care and go choose the 2nd or 3rd best...

Just like that minister what-was-his-name said, and quite sincerely... 'we want the very best (lol) to come to the UK, contribute to the economy, and THEN... GO HOME'. :lol: :lol:

Thanks Althlus, ..I realise that.

I just thought even if I am not persuading them to change the law I could highlight the problem. I cant feel myself a sheep. If our brains are used we should be treated well and have the same rights.
