T1(G) to ILR - Child/Partner - Query

Post by raghaw1782 » Thu Nov 14, 2013 12:01 am

Hi,
Im going to apply for my ILR soon. I would like to know, if my wife (who is not eligible for ILR yet and will have to go for extension) and baby can apply for their extension at the same time as me? Or do they have to wait for my ILR to come through and then apply for their extension?

Also, for them, what type of Applications should be used? I have read on UKBA site that Partner should be using FLR(M), but baby can use SET(o) which means can Baby apply with me at the same time?

http://www.ukba.homeoffice.gov.uk/about ... oservices/

And does my wife have to go for IELTS, although she has got certificates that he got taught in English for her degree?

Please advise

Thaks

When did your wife start living in the UK with you?
When did she become your dependant?
Was your baby born in the UK?

Hi Vinny,

My wife came into UK in Sep 2013 that is when she got her Visa.

The baby is born in India. The baby is in UK now as my dependant.

All our Visas expire in Jan2014.

Any advise on my case is much appreciated.

Thanks for the quick response though.

Your wife and baby may extend at the same time as you, or afterwards, before their leave expires. Baby will only be eligible for ILR at the same time as your wife.

Hi Vinny,

Thanks for the advise.

Just to confirm that I got this right.

Myself & baby will apply for ILR using SET(O), while my wife will apply for 'Extension of PBS Dependant Leave' (as it doesn't require IELTS unlike FLR(M) ).

Could you please advise which form will it be for my wife if it is not FLR(M) that she can use?

I will be going for same day service. My concern is, will my wife be given extension at the same time as me? Or do I have wait for the Biometric card for ILR to come through to me before I can apply for her?

See also How dependants can extend their stay (319C and 319H). They may apply with you if you book a family appointment.

Hi Vinny,

Thanks for your advise.

How can I book a family appointment?

When Im trying to book online, the options are individual.

In my case, can I book SET(O) with 2 dependants. 1 will be my baby for ILR and other my wife for PBS extension?

Thanks

I don't know. As they stated 'family appointments', I had assumed that they were bookable.
