Hello, I'm Jeennin currently in Glasgow.
I came in on a student visa, studied till may and dropped out of school cos I got pregnant and I have a medical condition which takes me to the Hospital every six weeks for a transfusion. So in July i got a lawyer from the Scottish legal Aid Board and they put in an application to the Home office for me, the FLR(O) family as a parent of a child(as my child is British) I'm still awaiting a reply.

The issue is my partner kicked me out of his house and I am presently homeless and i do not get any benefits at all. Any money i get comes from handouts from friends. My study visa expired last month and I cant work due to my failing health. Please i need help and advice as my baby and I are living roughly in the cold.

Firstly social services who should be helping. For the welfare of your child an application for benefits should be permissible, apply now, moreover, your leave to remain, if granted, should allow access to public funds. What Country are you native?

I am from Nigeria. I went to the social worker yesterday and they said that they cannot help me because it states no recourse to public funds and that i should seek asylum.

Asylum is probably inappropriate, unless you are fleeing persecution in your own country.

Medical grounds may also be difficult.

Social Services have a statutory duty (section 18 of the Children Act 2004) to ensure the safeguarding and promote the welfare of children. They should not 'fob' you off. They can make emergency payments and help organise housing. Like I said in the interest of the child's welfare a public funds claim should be acceptable in the circumstances and your FLR(O) if granted should allow access to public funds in the best interest of the child's welfare. Ask to speak to the social services/children's services manager. Explain you need help until your get your FLR(O).
