EEA Family Permit Rejection: Consequences

Post by chaoclive » Sat Nov 16, 2013 1:48 pm

Hey all

I have been noticing that the spouses of a few dual N. Ireland citizens with both UK and Irish passports have been granted an EEA FP.

I am considering trying this method to see if it works as the civil partner of an Irish national. He has received 2 UK visas in the past and I have been the sponsor each time (with details of my British passport on a cover letter I wrote for him). Would this be checked?

The application form [VF5] does not ask the question about being a dual national; this kicks in at EEA2. If this visa is successful, we would only be going back for a holiday so I'm not going to be faced with EEA2 just yet.

I would like to ask what you think the consequences of the rejection of an EEAFP are? Would that mean that my partner would have a bad immigration history with the British Embassy? Would that be held against him when he applies for future UK visit visas in the past? Any other negative consequences?

Thanks in advance
CC
