Multiple ILR questions, please help

Post by hamakhaa » Sat Nov 16, 2013 9:59 pm

Hello everyone,
I am planning to apply for ILR in the 2-3 months.I am on tier1 visa since 2009 and have some questions which I hope someone can help me out with them on this forum.

Question 1
Just to give you background I got my tier1 visa stamp on 26th Jan, 2009. I arrived in UK on 7th March,2009.The first question I want to ask is considering these mentioned date when should I be applying for ILR? 28 days before 26th Jan,2014 or 7th March,2014?

Question 2
When I applied for an extension after 3 years in 2012, I applied in the first week of January. My successful application was in process for two months and I got my visa/passport back in March 2012.To be precise the biometric card I got was from 23rd March,2012.This means that my visa stamp has almost two months gap (from 27th January 2012 to 22nd March,2012).Is this going to affect my application in any way ? Is going in person for this type of application ok or do I need to use postal application?

Question 3
On tier 1 (general) I arrived in March 2009 (as mentioned above), I started my first job in June.It took me like 3 months to find a job. DOes that in any way affect my application. Do I need to complete 5 yrs of employment,if this is the case I think I need to spend more time on tier1 ? Is that right?

Question 4
Is there any maintenance fund required ? If it is how much ?

Question 5
Regarding the absences evidence, in July 2010 I went for a month on holidays. From June 2009 to August 2010 I worked for one of the employer and then switched to another job which I started from 16th August,2016. Before I went for holidays I resigned from this employer but since my holiday were booked before my resignation I went out of UK in the end of the employment. Initially, I was planned to go for 3 weeks i.e. from 23rd July 2010 to 15 August 2013, but my manager told me that you can go a week earlier. Now the annual paid leaves I had were for 3 weeks but the passport stamp says 4 weeks. I am not sure how to show that 1 week holidays as it wasnt the part of paid annual leave. Since its been 3.5 yrs I left that company and God knows where that manager will be now,not sure how can I describe this? Can you please advice what should I do to manage this? Is this really a problem?

Question 6
Is it mandatory to have the absences evidence, as it would be really hard to get a letter from the previous employer?

Question 7
The PEO service, is it really hard to get appointment? Based on the date I have mentioned above in question 1. What should be the best time to start looking for appointments ?

Thanks in advance for your help :)

Hello Amber,
Thanks for the quick reply. After reading the FAQS I can omit some of the questions but still I have questions, please suggest me on the following.Apologies if I am just being too dumb.

Question 1
Just to give you background I got my tier1 visa stamp on 26th Jan, 2009. I arrived in UK on 7th March,2009.
The first question I want to ask is considering these mentioned date when should I be applying for ILR? 28 days before 26th Jan,2014 or 7th March,2014?

Now read the FAQ 4,5. To be honest I am not 100% sure on this.
It seems I have the 90 days concession but on the other hand I have leave expiring till March 2014

I don't want to delay if I can apply but on the other hand need to make sure if applying early is the right way to go? Please suggest.

Question 2
When I applied for an extension after 3 years in 2012, I applied in the first week of January. My successful application was in process for two months and
I got my visa/passport back in March 2012.To be precise the biometric card I got was from 23rd March,2012.This means that my visa stamp has almost two months
gap (from 27th January 2012 to 22nd March,2012).Is this going to affect my application in any way ?
Is going in person for this type of application ok or do I need to use postal application?

There was nothing related to this in the FAQs. Please can you suggest.

Again I am pretty sure it wont any affect but confirmation would be good from you guys.

Question 4
Is it mandatory to have the absences evidence, as it would be really hard to get a letter from the previous employer?
Nothing on this subject. It does says that we must have the letter but wt if we cant get any letter from the previous employer.

Thanks,
Hammad.

From 28 days before January date. If absences were <180 days per 12 month period no evidence should be requested. Other issues are not worth worrying about.
