FLR(M) application and the financial requirement.

Dear all

My wife is British and am Sri Lankan. My spouse visa will be expiring on December 2014. We are planning to have our baby soon and I have to renew my first visa extension, which is FLR (M). Now, my problem is when we apply for FLR application, I noticed we have to go through same application process of showing £18600 salary requirement. She is on £22k annual salary for last year but when we apply for my visa renewal she won’t be working, as she will be on maternity leave.

Will that be a problem because she is not working during her maternity? I know it’s a silly question but I wanted some clarification from all of you guys as UKBA are always mystery – am scared!!!

Please help!!

I panicked about the same thing, but with maternity they look at the six months prior to maternity leave so just ensure she keeps hold of her bank statements and payslips. Also remember your income counts now as you are in the UK too.

Thank you so much. Such a relief !!! Her income is 22k per annum. Hence, I don't want to include mine and confuse UKBA coz all they need is 18600 I think. So..hmmmm

Your case is covered by the old rules, therefore you will not be required to show that you earn 18,600.

Not sure that the OP has transitional protection Obie as they appear to have applied in 2013 :?
