Question on Leaves for ILR?

Hi,

I am a new member to this site and was referred by a friend. And I need to Thank friendly members and the Moderator to have this place for like minded people.

Now, I am planning to apply for an ILR, but have too many questions which I am detailing below. Please Please advice.

I came to UK on Work Permit on May, 09. In Jun, 10, got my Tier 1. After 2 years got my extension. After my extension i had to resign and move out of the job. After which, I am idle and looking for jobs. I fall into the bracket of 36K for ILR which is due for May, 14. In the same, I have been out of the country as follows

Year 4 - 128 days
Year 3 - Nill
Year 2 - 44
Year 1 - 28.

Now, in year 5, I am planning for another trip for 67 days.

Question 1: Can anyone advise if I can be on leave now?

And in year 4, I was out of country for personal reasons for 128 days (split into 88 and 40 days).

Question 2: Any advise if this would impact my decision for ILR

Also, in year 5 if I meet my 36 K pay.

Question 3: Can I apply for ILR.

Thanking, I have valid permission for end of next year.
