Tier 1 Dependent child (UK born) visa, Do I need TB Test?

Post by pshayer » Mon Nov 18, 2013 12:20 pm

Hi I have applied my Little one's Tier 1 dependent visa from India today.

He is 9 months old and born in UK. He went to India 2 months ago with his month.

We have submitted the application without TB Test certificate based on the following guidance.

Who does not need to be tested?
Applicants in the following categories are exempt from the tuberculosis test requirement:

- diplomats accredited to the UK;
- returning residents (unless they have been absent from the UK for more than 2 years);
- Certificate of entitlement holders (right of abode in the UK); and
- children under 11 years old (unless deemed necessary by a clinician).

Ref: http://www.ukba.homeoffice.gov.uk/count ... %20English

But a friend of mine just told me that his daughters visa was refused because of the TB screening test.

I am bit worried now. Is it possible to send the medical certificate after the application was made. OR Will I get chance to appeal?

Kind Regards

MED2.3 Who is exempt from needing a TB certificate? wrote:Children are not automatically exempt from the requirement to present a TB certificate showing that they are free from active pulmonary TB. Children under 11 years old need to attend a clinic, where their parent(s)/guardians will need to complete a medical questionnaire. The clinician will decide whether a chest x-ray screening is required and whether an individual certificate will need to be presented.

I was very worried after seeing few discussions over internet. But my little one's visa is granted today.

I applied without Tuberculosis test. on 18th Nov and collected the passport today from VFS Jalandhar, India.

Before applying I emailed VFS and British High Commission new Delhi got the following reply back.

"Dear Sir,

Thank you for your email dated xx/xx/xxxx.
The website clearly confirms exemptions for the TB test , where in children under 11 years old are exempted.
Regards

But I will still worried because some people says that they got refusal because of TB test.

I cover letter I clearly stated that Baby is UK born and all the vaccination has been done by NHS and next vaccination is due at the age of one year which will be done in UK again.

Just putting this information so that if any one fall in same situation as me can see some hope.[/i]

Hi,

We had traveled to India due to an emergency. We already had second extensions (except for my son who was born in UK in Jan 13) in Jan 14 for next 3 years. I already came back to UK and family will be expected in a month. I look forward to apply for visa for my son to allow him to enter in UK. Please could you guide me on following queries.

a) Do we need to keep maintenance funds for my son or entire family (1 main applicant & 3 dependents)? How much would be funds to be maintained?

b) Is TB test is necessary for my son?

c) What documents should be submitted? I already came back to UK. Should I post my passport & BRP to India for above application?

d) Hope I have to submit application and payment online.

e) We never traveled for more than 6 months in last 3 years. If I started maintaining funds for 90 days, then is there any issue during ILR applications for my family in August 14 ( regarding absences)

Early response will be highly appreciated.

Many thanks
