tier 2 ict role change

Post by mmitra » Tue Nov 19, 2013 10:53 am

Hi,
I am working on a Tier2 ICT visa since Sep 2010. I want to move to a similar role within the same company. However the legal entity of the new role is different from the one in which I am currently working. Can I continue to work on my existing visa?

same company but the legal entity of the new role different?

Read the T2 policy guidance para 198 and onwards to see under what cuircumstrances would a change of employment application be necessary.

If your new role is in the same SOC code, then you don't need a new visa, but if not, this will be classified as a change of employment which requires a new visa application. Not sure what you mean by same company but different legal entity.
If you don't require a new visa, still let HR inform ukba via sms of this change in role. see below reply I received from ukba;

Thank you for your enquiry which has been passed to me for response. If, at the time of applying for settlement, your job title differs from that stated on your original COS application then providing your sponsor has advised us of the change and as long as it is in the same SOC code and it isn’t too significant a change then this should not be an issue.

I hope this answers your question, should you require anything further then let us know

Regards
