Hi

I am on Tier 2 General visa at the moment. My core duties have changed, however my job title will still remain the same. But my salary will be reduced due to a new staff joining soon and will be taking over some of my work.

I have recently switched from PSW to Tier 2 General on SOC code 2137. My salary after reduction will still be above the appropriate rate as set out in the codes of practice. Would like to know if a change of employment application will be needed? The new salary will be less than that mentioned on the COS at the time of application, but will still be above the appropriate rate. But according to the last bullet point in Paragraph 200 from Tier 2 Policy Guidance it states that

200. A change of employment application is not required for other changes to your job. For
example if:

• you are remaining with the same employer and change jobs to a different job within the
same SOC code, or you are moving under TUPE (or similar) protection due to a takeover,
merger, de-merger or any other circumstances in which TUPE is triggered.
• your salary is reduced due to company-wide reductions defined as acceptable in the
Sponsor Guidance, or
• your salary is reduced due to maternity, paternity, adoption leave, and/or a period of sick
leave that lasted for one month or longer; or
• changes to your core duties which means your job changes within the same SOC code
(provided your new salary rate is at or above the appropriate rate for the job as set out in
the codes of practice).
