How to save tier 2 visa in case of company been taken over ?

Post by siddharthpandey » Thu Nov 21, 2013 10:47 pm

I joined this company "X" as full-time permanent employee when I had PSW visa and after completing 13 months my employer decided to sponsor me for tier 2 General visa.
Currently, my tier 2 visa is valid until September 2016 but sadly one of the other organisation, "Y" has taken over my company and Y doesn't have a sponsor license from UKBA. The process of taking over is still going on and that is the reason they are not able to give any response in relation to job specific questions from any employee. They have stated that it can take up to 3 months for this process.
I am really worried about this threat to my job as X is going to transfer all employees to Y under TUPE legislation but I have still not heard anything from Y that they will be filing an application to get a sponsor license as the buying process is still in progress.

I want to know what are my options under TUPE law to protect my employment with Y as what will happen
- if they are ready to get a license but their application gets rejected from UKBA due to any human/documents error
- if they are not ready to sponsor me.

- How can I save my stay in this country to work in this situation? I was relaxed few months before that its going to be fine as I have 3 years of visa now.

- If nothing works, how many days do I get to search for any other employer who can sponsor me before I must leave this country?

- Can anyone give any reference to any umbrella company who can also provide sponsorship?

Any help in my difficult matter will be very appreciated.

Thanks :?: :?: :?: :?: :?: :?: :?:
