My wife has a spouse visa. Is she entitled to work?

Post by pdon » Wed Dec 11, 2013 8:54 pm

Hi,

I am a UK citizen, I got married to my Brazilian wife last year and she successfully applied for a spouse visa. She is now living with me in the UK.

A prospective employer asked to photocopy her passport and visa page as part of their checks regarding her entitlement to work here in the UK. But they seem to have expected to see something stating her entitlement to work on the visa (entry clearance) page. She previously had a residence permit while she was a student (before we married) which specifically stated that she could work for up to 20 hours per week, but the entry clearance page in her passport doesn't mention anything about this. It only says, "Settlement to join/acc partner - [my name]" under type, nothing about work.

I have found a couple of website which say that she can work on a spouse visa, such as here:
http://www.visalogic.net/united-kingdom ... t=4&t2=103

But so far I haven't been able to find anything on an official website, such as the UK Border Agency website.

I'm confident that my wife is entitled to work with her spouse visa. Does anyone know of any official evidence of this?

Thanks,
Paul

Yes, of course she can work. If the employer has any doubts they should contact the employer help line at the UKBA

Thanks for that. Yes, I'm sure she can work. I'm just surprised that I can't find any official statement to this effect. If I was Bulgarian or Romanian, I can find a page on the UKBA website that says my wife could work here but there's nothing that I can point to that covers the wife of a British citizen.

I think that the employer was expecting to see a statement about entitlement to work on her visa but my understanding is that there would only be a statement if there were restrictions on her employment.
