Hi guys, first of all thnks to everyone reading my post.. I ambit confused about long residency situation... Here is my senerio... I applied student extension in oct 2008 was refused in dec2008 I appealed against that decision n appeal was dismissed in feb 2009.. Then I met a lawyer she said we gunna apply outside immigration rules fresh application n the basis gunna b my academic results n got visa in July 2009.. But I applied in 28 days threshold .. I read a thing in policy guidance ( long residency ) they states if an applicant make every effort to stay legal than case worker should make decision in favor... So guys I need ur expert opinion on that please ... Ur suggestions will be valuable for me.. Thnx

As far as I think, your leave expired when your appeal was decided. You were in breach of immigration law until you were granted leave. If my thoughts are technically correct, then most likely they will refuse you ILR.

Lets see what others have to say.

By the way, can you pinpoint where you read what you say? A link?

So far as you applied within 28 days of the appeal determination and that application was successful then you should be fine.

That's ok so far as the next application was within 28 days and subsequently successful.

Thnx for ur mixed replies guys... That's what I am getting From qualified n experienced solicitors ... The pin point was if u go through the policy guidance of long residency example pages (breaks). U will find there... I asked a lawyer he said if u applied within the time then new rules benefits you.. N this is general practise on any uk immigration laws that Any new law affecting people who they applied in previous rules then home office shilould give benefit... It's same in cricket when umpire isn't sure bout decision then he always gives(benefit of doubt ) to batsman lol.. I need more comments or any similar case ref will highly appreciated thnx
