when to apply for ILR?

Post by hanara » Thu Dec 19, 2013 11:17 pm

Dear members and Gurus,

I got my work permit visa stamp on 22/01/2009 and entered UK on 16/02/2009.
1.Am I eligible to apply for ILR 28 days before 22/01/2014 or 28 days before 16/02/2014?
2. If it is 28 days before 16/02/2014 then I will have only 2 days before my current visa expires,ie 20/01/2014 to apply for ILR. Do I have to apply for extension of my current visa or is it safe enough to take a risk?
I am bit concerned. Can any one help?

in your case, your 5 yr qualifying period starts from WP visa stamp date. so use that date to work out the 28 days window for ILR application
Please do not send me PM if I haven't sent you one yet.

Thank you sir for your kind reply.
For the benefit of other members who may have this doubt, I have also clarified this with the UKBA itself and they have concurred with this opinion.

hanara wrote:Dear all,
I am applying for my ILR (work permit 5yr route) and I greatly appreciate your advice.

Initially I had thought of applying by post but today I noted that the waiting times for postal application can be upto 6 months but the PEO applications will be decided on the same day!
Should I apply by post or by PEO route?
Will all postal applications take that long time?
I believe my application is straight forward.
I have not made any appointment for PEO yet. My current leave to remain will expire on 22/01/2013.
What are the chances of getting an appointment with PEO if I try to book it now?
Should all dependents need to attend the interview?( my wife and two children aged 5 and 8)

Gurus and experts please help
