advice on eea family permit

Post by Blairwitch » Sun Dec 22, 2013 12:26 am

Hello everyone. I am new here and I will appreciate any advice anyone can give.

I am a Filipino living in my home country and my fiance is a Dutch national. We met each other last April of this year online, he came over here to meet me in June and we've been talking everyday ever since we met. We have viber chat logs and call logs as a proof we are communicating everyday and we have holiday pictures with my 5 yr old kid and pictures with my family as well. We decided to get married in February on his next trip here. I know this sounds like a whirlwind romance but this is in no way a marriage of convenience.

We want to live together after we get married and we are hoping to settle in UK using the family permit option as moving on Holland requires me to take the Dutch exam for me to live there and be able to be fluent in Dutch for me to get a job.
My fiance doesn't make much money and has his own daughter to support so I really cannot afford to be his plain housewife. He is planning to find a job in UK while still in Holland so we have the security of him having an assured income before we move there.

My questions are:

1. Do you think there's a great chance of me bring refused as we have never lived together?
2. Does it technically means that we have to be on the same flight when declaring travelling together wherein we will be coming from different countries?
3. Once granted, do we have to fly to the UK immediately? We were thinking that it would be better for him to apply for jobs when we have the permit already as companies prefer to hire someone who is immediately available to start. How long is the maximum period once I have the permit can I wait before we travel.
4. Should I include my 5 year old kid in my application already if we do not plan to take her with me right away? We will be just renting a couple room since we do not have much money yet and agreed I will get my kid once we are already settled and we both have jobs and can afford an apartment of our own.

I'm looking forward for your responses and will appreciate any advice. Thank you!

!) No way of knowing in advance but everyone who gets married starts from the same position in theory

2) No you can be travelling to join your husband as well just not before he arrives.

3)You have six months to travel on the family permit he doesnt need one at all.

4) Depends if you think your child is likely to travel in the six month period so up to you.

Dont forget the NSO birth certs for you and your child and the CFO in the Phils Manila or Cebu and if your child has the fathers name on their Birth Certificate you will need his permission for the child to leave and have that documented

Good Luck

Thank you so much for giving clarifications. As for the consent of the father of my kid I don't have to worry about that since he is not declared on the birth certificate. Thanks again!
