Can I get married while my finace is on tourist visa

Post by Saihus3 » Sat Dec 28, 2013 2:27 am

Hello everyone i would just like to know if me and my fiancé can get married if he comes to the Uk on a tourist visa. He's a spanish resident but has a Pakistani nationality. We are planning to apply for a normal tourist visa, and then get married when he comes here, is that possible?

I also have a question about applying for a visa if we get married in Spain and apply from there.
I have a full time job, but I'm not earning 18,6k a year. I am currently earning 14,5k, and i have a permanent job in a call centre and have been working there for 8 months now.

What can i do in my situation.

Thanks

The simple answer is 'technically no, practically yes'.

In other words - there is a visitor visa specifically for getting married and officially the 'standard' visitor visa is not for getting married on.

So if he turned up at the border with a 'standard' visitor visa and said 'I'm here to get married' - he'd be turned around. Applying for a marriage visitor visa will require strong proof he's going to leave at the end of the time here.

But if he got a standard visitor visa without a plan to get married, turned up, and then you changed your mind and decided to get married - there's nothing stopping you.

In terms of 'what can you do if you're not earning enough' ... there's four answers:

1) Find another job which pays more than threshold and wait 6 months

2) Top up the income with savings - given you have a ~4k shortfall - you'll need £26,250 in savings in EITHER of your accounts for 6 months prior to application.

3) Move to be with him in Spain and find a job there, exercise your treaty rights for a period of time, then return with him on an EU family permit (which has no income requirement). But you should be aware of the tightened requirements on this route which may require you to move wholesale if you hope to succeed anytime soon: http://www.immigrationboards.com/viewto ... sc&start=0

4) Find a visa which would allow him to come here and work (Tier 2 probably)

Hi, I am a settled person in Uk, my girlfriend lives in another city in Europe and she is coming here for holidays, she doesn't need to apply for a tourist visa, she normally gets 6 months tourist visa everytime she comes, this will be the third time.
My question is, once she is here on a tourist visa, are we allowed to get married here in UK?? we don't want to apply for a visa here, we just want to get married as it is easier here then in the country where she lives. If that is possible it would be great!!

Please your help will be much appreciated.
