Spouse visa extension if she lived abroad for long duration

Dear all,

I have a quick question and need your advice on this issue.

My wife is a national of non EEA country and currently living with me in UK since November 2013 as a dependent.
I'm a british citizen and due to move soon to USA on L1 visa due to work reasons.

When my wife's visa will come to expire in couple of years time then would there be any possibility that she could extend her spouse visa ?
Keeping the fact in view that I'm working in USA from past 2 years and she is living with me there at that time ??

Dear amber,

She is here on the basis of "dependent of a settled" i.e I had an ILR when she was granted an entry clearance.

See also Time spent outside the UK. However, it may be difficult to apply for FLR(M) or SET(M), if you are working in the USA at the time.

If you have proof of cohabitation and subsisting relationship in the US, then you may be able to use such time towards the required 5 years for settlement. However, in your other post you're applying for PBS dep so it's rather confusing, :?

Search for a recent person who had success, the couple spent a considerable time abroad I think South America, before returning and being granted SET(M). It was a recent post.
