cap rule?????????????

hi fellows,
one of my friend is on tier 4 visa,her scenerion is ....

-she got UK students visa in april 2007 for BBA course ,visa valid till september 2011-----(after her arrival that college was closed and she did not study at all through all these 4 years)

-on september 2011 ,she got CAS freom a different college in level 5 diploma in managemnt,,UKBA gave her visa from october 2011 to february 2014 ....she has finished her level 5 diploma and college is issuing a transcript internally not from any awarding body...

--now the scene is her current college is offering her a CAS for level 6 to apply for student extension ..

my questions are:
-can she apply for tier 4 student due to cap rule apply or not on her case?

her colle is telling her that u dont need to worry u will get visa ,cap does not apply in ur case ,,
plz plz plz advise seniors.thanks in advance

According to me, she only got 1 more year to study at degree level.(i.e.Level-6). So if offered CAS is for one-year, than college is right about cap. If course is more than one-year, than college is wrong.

Study Cap/Limits apply on each and every Tier-4 visa application where applicant studied in UK previously, regardless it's an in-country application or home-country application.

thanks for reply .
one more thing if she applies now for tier 4 extension ,and due to any reason(cap rule )her visa got refused,,do u think she can marry with british national .is that thing possible that she can put new aplication of marriage after tier 4 refusal within 28 days?

Usually refusal comes after current visa expired and I don't think its possible that she can switch to another category without valid visa. So she needs to leave UK and apply from home country.
