dependent appeal.. urgent help needed..please help!

Hi, i applied for dependent visa with my wife within UK since she was pregnant and i could not leave her alone to apply from outside UK but her visa got rejected and so did my since i applied as her dependent. but on second try she got her visa but i did not apply with her since i had already appealed against the decision and i now have a hearing in Feb. Most likely it will be a human rights case since i cannot leave the baby and wife alone.

my wife will be present with me with the baby in the court during the appeal but after that she will be going out of UK for a couple of weeks and i will be in UK waiting for the decision. Can someone please help if she can go and if there is any need for her to stay in UK till i get my visa?? Please advise ASAP as we will be booking her seats soon. I really need to know if its ok for her to leave the country with the baby while im waiting for the decision and visa?? thanks
