I would like to have expert advise on my case.
Here is the background,
I am on Tier 1 (General) which was previously HSMP. I submitted my extension application in April, 2013. I am earning dividends from limited company. My company financial year March to Feb. I claimed the income from April, 2012 to March 2013 which falls in two accounting periods of my company. Because it falls in two accounting periods my accountant said it is absolutely ok to submit the managed accounts.
In September 2013 I got refusal letter from HO stating not disputing my income but refused to give me points for my earning on some other reasons like my directorship was not evident with HMRC paye, I am not declared any salary as a Director from the company ( I claimed all the income as dividend). I appealed to the tribunal giving the reasons that my directorship was clearly evident in Annual returns to the Company house, and not evident on PAYE because I am only withdrawing all the income as dividends.
I got hearing date on 23rd December, 2013 but I received a call on 19th December from presenting officer informing me that he is not happy with the UKBA decision of refusing me LR and he is withdrawing the case and sending the application to HO for reconsideration.
Now I got the second refusal letter from HO stating the same reasons giving me the chance to appeal again. I hope I explained the case clearly.
I am considering to appeal again.
Any suggestions what happens next.
