Visa appeal

Hi i have applied for flr(o) in 2012 may, and i got first appeal date for this march 14th, my previous visa status was tier4 student, i am in this country from 4.5 years, now i think it seems to be that i wont win the appeal and i want to apply student visa again, any idea, can i apply student visa before the appeal date or will i get a chance to switch visa after appeal fail?
