A question from a friend:

From East Africa and been in UK since October 2002 under WHM. The visa will expire at the end of next month.

Married in July 2004 to a person from Accession State who has been in UK
since February 2004 under Au Pair and then changed to Worker Registration Scheme in June.

Both are working and have enough fund to support them.

Wants to apply for a family member residence stamp but not sure whether he will be allowed to make in country change or will be forced to
go back to East Africa and apply from there.

The form EEC3 is straight forward and they can apply without involving a solicitor but they think if this can be treated as a complex case then it will be good to apply through a solicitor.

What do you think?

My take on this is that your mate applies through a solicitor/immigration lawyer and should get all the documentation ready and set the ball rolling. I think it will be money well spent (dont go for the so called immigration advisors!!!)

Thanks, do you think it will be possible to change in country even if he
is a visa national?

I know It is not possible to change for example from WHM to student visa
but I am not sure when it comes to marriage.

Bambu,

Your friend can apply on EEC whilst in the UK - no need to go back. He can do that after his family stamp - take his wife on a honeymoon calling at Mombasa , Dar and of course Kampala so as to sample what EA has to offer. IMHO there is no need for a solicitor - I don't note any complexities e.g. outstanding asylum case/ appeals or adverse immigration history. Save the money for the honeymoon and accompanying refreshments - Tusker, Nile and Kilimanjaro/ safari :lol: .

The stamp will be restricted to June 2005 (duration of WRS card). However the spouse should get full EU residence rights after June 2005 which will be extended to him.

It seems you have travelled alot or you have many friends. Tusker, Kilimanjaro and Safari are very known type of beer in East Africa.

With the sun and temperature above 30 centigrade, those beers when cold
can be very refreshing.

I know you have been to Dar and Nairobi, but I am not sure about
Zanzibar and Kampala.

Next time include Zanzibar in your plan. It is very live during the night
And it’s a good place to be if you are male and single.

I just never thought Kayalami would know about safari and Kilimanjaro. She/he has proved me wrong.

My mate laughed a lot after reading kayalami's advice and he said unfortunately he will have to hide it from his wife, other wise the pressure from his wife of having a second honey moon in EA will be very high.
