Need Urgent Advised

I applied for Tier 4 visa for MBA January 2014 intake from University and got refusal because unfortunately £ 70 pounds were less for 2 days from my maintenance fund which I did not notice.I got appeal right. Can any one let me know what to do in this situation? I went to see one solicitor who said there is 0 chance for your case. simple is that there is clear rule and guide line which you did not follow. other one says you can load appeal and same time you can apply new application. please guide me what should i do?

secondly I am regular University student and taking all the classes from January but now university is asking me to pay remaining fees. I am afraid that if the appeal decision comes against me than what about fees which I already paid to university. The university says if you want to continue your study you have to pay if not than you can withdraw and we will return your amount by deducting some amount.
My question is this that if I am going to appeal and same time going to withdraw with university than what would be my status and than Can I apply new application?

You can't win the appeal, so there's no point. You have to make a fresh application. So you have to ask the University to issue you a new CAS and you have to £9000 as your maintenance fund. Your University supposed to check your bank statement, I don't know how come they have missed that.

Many thanks for your reply. My visa expired on 27 December 2013. University says we would be able to issue you new Case if your visa would be valid. Straitaway, they are saying we can't do any thing.

Secondly how much I need to maintain £ 7200 or 9000?
I am maintaining 7200.

If you are studying an University outside of London then you have to show £7200.

If you are a continuing student with the University and you have a refusal letter from UKBA that you can make a fresh application within their given time frame then you should be able to get a CAS from your University. So go and talk with them show them the letter they will provide you some solution.
