visa for my child

Dear Sir/Madam
My son born IN 2007 abroad in Tunisia before I get ILR iN 2009.
now I am British citizen My son 6 years live with my wife she is diplomat in Belgium.
what to do to have british passeport for him
please help

He will need to live in the UK to become a BC. Also the status of his mother can affect his application.

I assume your son was not living with you in the UK when you applied for ILR and Settlement and he wasn't joined in either application.

He's not automatically entitled to a British passport because you are a British citizen. As Jambo said, he would need to live in the UK and meet certain requirements before being eligible to apply for citizenship and then a passport.

This page explains how your child can join you in the UK if you are a British citizen
http://www.ukba.homeoffice.gov.uk/visas ... /children/ As you can see, even in applying for a visa for your son to live in the UK, your wife's status is taken into consideration.

Even if your son is granted this visa, he would then need to be resident for 3 years in the UK and the requirements for registration under s 3(5) British Nationality Act. These are requirements that need to be met by both you and your wife as well.

You could also try for registration under s 3(1) British Nationality Act (registration is in the child's best interest), but seeing as your wife seems to be the main caregiver of your son and lives with her in Belgium, on the current facts it would be unlikely that it's in the child's best interest under this category.

Separately, what nationality does your child hold?

I don't think that 3(5) is applicable here, as neither parents are British by descent.

Yes. Section 3(1), by Discretion, would be applicable.

It would be difficult to apply for a settlement visa, if he is living with his mother, outside the UK. Perhaps, Tier 4 (Child): student visa?

I have good job here
and I don't think so I will have one in Belgium and I likes here I feel my self home
please could you tell me wich application I need for my child to come here
he is 6 now and I spoke with my wife che will give authorisation to bring him here in London
