apply different visa while waiting for hearing

I came in UK as a student.My wife is my dependent and we have a baby.We Applied our visa on article 8 to extend our leave to remain under medical ground.our visa was refused. I appeal for this refusal decision and waiting for a hearing on late July 2014 by tribunal.
either me or my wife can applied for student Visa now while we are waiting ??

You cant make an application while you have an appeal pending.You have to withdraw either the appeal or the application.
